The Principal Bench of the High Court of Karnataka (comprising Chief Justice Mr. Vikramjit Sen and Justice Mrs. B. V. Nagarathna) ordered issue of notice on 21 Nov 2012 in the Public Interest Litigation (Writ Petition No. 41532/2012) filed by Environment Support Group, Bangalore (ESG) and listed the matter for further consideration for the fourth week of January 2013.

We share with shock and utter dismay that the Karnataka State Biodiversity Board, a critical regulatory body to implement the Biological Diversity Act, has resolved recently that it will not initiate criminal prosecution against M/s Monsanto and M/s Mahyco and others involved in biopiracy while developing India's first GMO food: B.t. Brinjal. This decision was taken in the 19th meeting of the Board held on 20 January 2011.

National Biodiversity Authority to prosecute Mahyco/Monsanto and collaborators promoting Bt Brinjal in violation of Biodiversity Protection Law

In an unprecedented, though much delayed, decision, the National Biodiversity Authority of India (NBA) has decided to initiate legal action against M/s Mahyco/Monsanto and their collaborators for accessing and using local brinjal varieties in developing Bt Brinjal without prior approval of the competent authorities.
